Privacy policy.

This page sets out the privacy policy used by Nic Monks Jewellery to protect any information you give me when using this website.

 I take the privacy, including the security, of personal information I hold about you seriously.  This privacy notice is designed to inform you about how I collect personal information about you and how I use that personal information. 

Please note that I collect the minimum information I feel I need to run this website and business.  I will not share or sell any of your data with other companies or businesses for marketing purposes.

I may update this privacy notice from time to time.  This version was updated on 27/09/2022.

1. Key Definitions

Personal Information: in this privacy notice I refer to your personal data as ‘personal information’. ‘Personal information’ means any information from which a living individual can be identified.  It does not apply to information which has been anonymised.

2. Details of personal information which I may collect and hold about you

  • Name

  • Contact information including email address, delivery address, billing address, telephone number(s)

  • Payment/Transaction information such as details of your previous orders and payments

  • Marketing data including your preferences relating to receiving marketing and email communications

So that I am able to provide you with goods and services, I will need your personal information.  If you do not provide me with the required personal information, I may be prevented from supplying the goods and services to you.

3. Details of how and why I use personal information

I am only able to use your personal information for certain legal reasons set out in data protection law.  There are legal reasons under data protection law other than those listed below, but in most cases, I will use your personal information for the following legal reasons:

  • Contract Reason: this is in order to perform our obligations to you under a contract I have entered into with you;

  • Legitimate Interests Reason: this is where the use of your personal information is necessary for my (or a third party’s) legitimate interests, so long as that legitimate interest does not override your fundamental rights, freedoms or interests.

  • Legal Obligation Reason: this is where I have to use your personal information in order to perform a legal obligation by which I am bound; and

  • Consent Reason: this is where you have given me your consent to use your personal information for a specific reason or specific reasons.

I hold your information to enable me to provide you with my services and to meet your needs for example, through

  • Record internal keeping, e.g. for audit/accounting purposes

  • To process your orders and provide you with the services you’ve requested

  • To improve the products and services I offer and understand how customers and visitors use my website

  • To send out promotional emails to the email address you have provided when you have indicated that you are happy to receive such marketing information

  • To ensure the smooth running and correct operation of my website

Where I rely on consent for a specific purpose as the legal reason for processing your personal information, you have the right under data protection law to withdraw your consent at any time.  If you do wish to withdraw your consent, please contact me using the details set out at the beginning of this notice.  If I receive a request from you withdrawing your consent to a specific purpose, I will stop processing your personal information for that purpose, unless I have another legal reason for processing your personal information, in which case, I will confirm that reason to you. 

4. Details of who personal information may be shared with

I may need to share your personal information with other organisations or people.  These organisations include:

  • Payment providers: Stripe and Paypal

  • Website Host: SquareSpace

  • Email platforms: Microsoft Office 365

5. Your rights under data protection law

Under data protection laws you have certain rights in relation to your personal information, as follows:

  • Right to request access: (this is often called ‘subject access’).  This is the right to obtain from me a copy of the personal information which I hold about you. I must also provide you with certain other information in response to these requests to help you understand how your personal information is being used.

  • Right to correction: this is the right to request that any incorrect personal data is corrected and that any incomplete personal data is completed.

  • Right to erasure: (this is often called the “right to be forgotten”). This right only applies in certain circumstances.  Where it does apply, you have the right to request me to erase all of your personal information.

  • Right to restrict processing: this right only applies in certain circumstances.  Where it does apply, you have the right to request me to restrict the processing of your personal information.

  • Right to data portability: this right allows you to request me to transfer your personal information to someone else.

  • Right to object: you have the right to object to me processing your personal information for direct marketing purposes.  You also have the right to object to me processing personal information where our legal reason for doing so is the Legitimate Interests Reason (see section 4 above) and there is something about your particular situation which means that you want to object to me processing your personal information.  In certain circumstances you have the right to object to processing where such processing consists of profiling (including profiling for direct marketing).

6. Third Party Websites

My website may contain links to third party websites.  If you click and follow those links then these will take you to the third party website.  Those third party websites may collect personal information from you and you will need to check their privacy notices to understand how your personal information is collected and used by them.

7. Details about how long I will hold your personal information

I carefully consider the personal data that I collect and store, and I will not keep your information in a form that identifies you for longer than is necessary for the purposes set out in this notice or as required by applicable law. In some instances, I am required to hold data for minimum periods: for example, UK tax law currently specifies a six-year period for retention of some of your personal data.

8. Cookies

Like most websites, mine will ask you for permission to place cookies on your device’s hard drive/storage.  Cookies are used in the normal functioning of the website and to help analyse web traffic data

The website will present you with an option to opt in/opt out from accepting these cookies.  I cannot guarantee that all my website functionality will function if you opt out.

The website includes the following key cookies:

  • CART - Shows when a visitor adds a product to their cart – kept for 2 weeks

  • Crumb - Prevents cross-site request forgery (CSRF) – persists for duration of session

  • hasCart – Tells the site you have items in your shopping cart – kept for 2 weeks

  • SiteUserInfo – identifies a user who logs into a customer account – kept for 3 years

  • ss_cookieAllowed – remembers if you’ve agreed to storing cookies – kept for 30 days

  • ss_cvr and ss_cvt – performance tracking cookies to help us understand how the website is used.  These are not essential to the the website’s functionality and expire after 2 years if they have been accepted
